Terms of Service

§ 1 Scope

1. These Terms of Service (“Terms”) govern the use of PalTweak, a web service operated by Florian Breuer, FB-Development, Kaiserforst 41, 33378 Rheda-Wiedenbrück, Germany (“we”, “us”, the “Provider”) at paltweak.com and all associated services.
2. These Terms apply to consumers and entrepreneurs as defined by German law (together “Users”, “you”).
3. Deviating terms of the User do not become part of the contract unless we expressly agree to them in writing.

§ 2 Subject matter of the service

1. PalTweak is a browser-based editor for Palworld save files. You upload a copy of your Level.sav, edit its contents — for example a Pal’s level, IVs, passive skills, moves, souls, gender and species, add, clone or delete Pals, and edit your player character — and download the edited file to use in the game.
2. The available features depend on the selected plan (Free or Pro) as described in the current pricing overview.
3. We may further develop the service and expand, modify or restrict features, provided the essential contractual services remain materially unimpaired.
4. PalTweak is an independent, fan-made tool and is not affiliated with or endorsed by Pocketpair, Inc. or the Palworld game.

§ 3 Registration and user account

1. Uploading and editing require registration, which is free of charge and handled via our authentication provider.
2. You must provide truthful information during registration and keep it up to date.
3. Each User may create only one account. Access credentials must be kept confidential and not shared.
4. You are responsible for activity under your account, except for unauthorized use you did not cause.
5. We may suspend or delete accounts in the event of a breach of these Terms or misuse of the service.

§ 4 Plans

1. Free plan:a free plan with a limited feature set, currently including setting a Pal’s level and adding or cloning Pals, as described in the current overview.
2. Pro plan: an extended plan that unlocks the full editor — all remaining Pal stats, moves and passive skills, deleting Pals, and the player editor — as described in the current overview.
3. We may adjust the features of a plan. Material restrictions of paid features will be announced with reasonable advance notice.

§ 5 Prices and payment

1. The Pro plan is unlocked by a one-time payment at the price stated in the pricing overview. It is not a subscription; there is no recurring charge and nothing to renew or cancel.
2. Pursuant to the small-business regulation under German VAT law (§ 19 UStG), no value-added tax is charged.
3. When paid checkout is available, payment is processed by our payment service provider. Completing a purchase constitutes acceptance of that provider’s terms.

§ 6 Term and termination

1. Free plan: may be used for an indefinite period and ended at any time by deleting your account.
2. Pro plan: the one-time upgrade unlocks Pro features for your account. Because it is not a subscription, there is no renewal and no periodic termination is required.
3. The right to extraordinary termination for good cause remains unaffected. Good cause includes, in particular, a material breach of these Terms.

§ 7 Right of withdrawal for consumers (digital content)

1. As a consumer you generally have a statutory right to withdraw from a contract for paid digital content within fourteen days.
2. Where you expressly consent to us beginning performance before the withdrawal period expires — i.e. unlocking and using Pro features immediately — and acknowledge that you thereby lose your right of withdrawal once performance has begun, the right of withdrawal lapses in accordance with § 356 (5) BGB.

§ 8 Availability and maintenance

1. We aim for high availability but cannot technically guarantee 100% uptime. Temporary unavailability, for example during maintenance, does not constitute a defect.
2. We are not liable for outages caused by force majeure, third-party provider disruptions or circumstances within the User’s sphere.

§ 9 User obligations

1. You may only upload save files that you own or are otherwise entitled to edit. You must not upload files or content that is unlawful or infringes third-party rights.
2. You are responsible for backing up your original save files before editing. Always work on a copy, and make sure the game and any associated server are fully closed before you replace a save file.
3. You must not misuse the service, circumvent security mechanisms, or impair its operation or availability.
4. You indemnify us against third-party claims arising from your unlawful use of the service.

§ 10 Intellectual property

1. The “PalTweak” name, logo and the design of the service belong to the Provider and may not be used without prior written permission.
2. PalTweak incorporates third-party open-source components, which remain subject to their respective licenses.
3. Your save files and their contents remain yours. We acquire no rights to them beyond what is necessary to provide the service.
4. “Palworld” and related names and trademarks are the property of their respective owners.

§ 11 Disclaimer and limitation of liability

1. Editing save files carries inherent risk.An edited file may become incompatible or unusable in the game. You use the service at your own risk and are strongly advised to keep a backup of your original save. The service, and in particular the Free plan, is provided “as is”.
2. We have unlimited liability for damages arising from injury to life, body or health, and for damages caused by intent or gross negligence.
3. For slight negligence, we are liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), and only up to the foreseeable, contract-typical damage.
4. Any further liability is excluded. This exclusion applies in particular to indirect and consequential damages, loss of data due to failure to keep backups, and damage arising from content linked to or created with the service.
5. Mandatory liability under the German Product Liability Act remains unaffected.

§ 12 Data protection

We process personal data in accordance with the GDPR and applicable German data protection law. Details are set out in our Privacy Policy. In particular, uploaded save files are processed in a temporary session only and are never stored permanently.

§ 13 Amendments to these Terms

1. We may amend these Terms with effect for the future where this is reasonable taking into account the interests of both parties.
2. We will notify you of amendments in an appropriate manner before they take effect. If you continue to use the service after the amendments take effect, this constitutes your acceptance.

§ 14 Final provisions

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory protections of the law of their habitual residence remain unaffected.
2. The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
3. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions is not affected.
